Consulting Agreement Proposal
Owner's Representative Services
1. Scope of Services
As an independent Owner's Representative, Boomer Group Inc. will act strictly as an objective expert advisor, advocate, and quality assurance check on behalf of the client during the ongoing renovation.
A. Pre-Construction & Documentation Review
- Contract & Scope Review: Review existing builder contracts, line-item budgets, allowance schedules, and plans to identify potential gaps or oversight risks.
- Baseline Schedule: Confirm builder's projected timeline and established progress payment milestones.
B. On-Site Quality Control & Accountability
- Site Inspections: Conduct scheduled site visits and key milestone walkthroughs to verify that construction progress matches design plans, engineering specs, and local building standards.
- Rough-In & Pre-Drywall Verification: Inspect framing, mechanical/electrical/plumbing rough-ins, and finish prep work prior to concealment.
C. Financial & Change Order Oversight
- Draw Request Audits: Physically inspect the site prior to the release of each progress payment to verify claimed completion percentages before funds are disbursed.
- Change Order Management: Review all contractor-submitted change orders for scope validity, fair market pricing, and impact on project schedule before client approval.
D. Communication & Reporting
- Status Briefings: Provide brief written/photo reports following key site visits outlining completed work, upcoming milestones, and items requiring builder resolution.
- Milestone Punch Lists: Assist in drafting comprehensive punch lists at substantial completion to ensure quality standards are met prior to final payment.
2. Fee Structure & Terms
Monthly Retainer
Billed on the 1st of each month. Includes scheduled site visits per month, draw audits, and routine client consultations.
Fixed Project Fee
25% initial deposit with the remaining balance distributed across equal monthly installments or key milestone reviews.
Hourly Advisory
Billed bi-weekly against an initial retainer. Covers all site visits, plan reviews, phone calls, and site documentation.
3. Independent Consultant Disclaimer & Terms
Role & Liability: Consultant provides independent advisory and project oversight services only. Consultant is not the General Contractor of Record, architect, or engineer for this project. The primary General Contractor/Builder retains exclusive legal responsibility, liability, and control over construction means and methods, job site safety, trade management, code compliance, permits, and product/workmanship warranties.
